Personal Injury AND Workers’ Compensation Lawyer in San Diego | Bates Law

As compared to other areas of the law, there are relatively few experienced Workers' Compensation attorneys (who represent injured workers).  This is because Workers' Compensation law has an extremely high learning curve, very complex procedure and in many situations, counter-intuitive rules and policy.  In addition, the fees paid are considered lower than in other areas of practice.  Therefore, Personal Injury attorneys (who handle bodily injury claims due to the Negligence of others) will not typically handle the Workers' Compensation aspect of their client's case.  And highly experienced Workers' Compensation attorneys often do not handle their client's Personal Injury case.

At Bates Law, we handle both.  We are also often brought in by other counsel to handle a portion of their clients' cases.  This has an enormous benefit to the client because when a client is pursuing a Personal Injury claim contemporaneously with their Workers' Compensation claim, there can be competing interests.  

For example, the sum of the costs incurred for benefits paid in the Workers' Compensation claim acts as a Lien against the Personal Injury case.  Then, when there is a settlement or Award in the Personal Injury case, the net recovery to the client acts as a Credit against the client's future benefits, effectively halting all further payments and benefits such as medical treatment.

There are defenses to both the Lien and the Credit which must be understood by the attorney(s).  Timing becomes very important and if there is more than one attorney on the two cases, cooperation is paramount.  At Bates Law, we take great pride in our track record of handling both cases ourselves and working with other counsel to obtain the maximum net result for our clients.

Mr. Bates is a Personal Injury and Workers’ Compensation attorney who has been in practice for over 19 years.  He has successfully handled numerous multi-million dollar cases and continues to deliver exceptional results for his clients.

Prior to practicing law, Mr. Bates graduated from California Western School of Law in San Diego, California where his focus was on all things related to Trial work.  Prior to that, he graduated from the State University of New York at Buffalo where he graduated with honors with a Bachelor of Arts in Legal Studies and a Bachelor of Science in Business Administration with a concentration in Finance.

In his spare time, Mr. Bates enjoys mountain biking, hiking, and going to the beach with his family.

Mimi is a Legal Assistant with Bates Law. Mimi attended college in San Diego, where she majored in Criminal Justice and earned a Paralegal Certificate from the University of San Diego.

Mimi takes great pride in providing outstanding service to our clients.  Mimi enjoys being part of a team where she can assist people with real life problems on a daily basis. Mimi’s responsibilities include assisting attorneys and paralegals, handling important legal documents and answering phones.

Mimi speaks, reads, and writes Spanish fluently.  In her spare time, Mimi enjoys going to the gym and spending time with her daughter.

RAUL GONZALEZ

A graduate of the University of San Bernardino, Raul Gonzalez Jr. earned a Bachelor of Arts degree in Political Science. In 1997, Raul also earned a Graduate Level Paralegal Certificate from the University of San Diego.

With 19 years of Personal Injury experience, Mr. Gonzalez has helped individuals who have suffered injuries through the fault of others, including car and truck accidents, motorcycle wrecks, tractor trailer accidents and wrongful death cases.  Through this experience, Raul has honed his legal skills greatly. His education, practical experience, strong work ethic and keen interest in the law enable him to serve both the firm’s clients and his community.

Raul is currently a third year law school student in Mexico and is expected to complete his degree December 2017.  He is acting as a Law Clerk and Case Manager with the firm and is expected to take the California Bar Exam in 2018.  In his current position, Raul helps in every aspect of the successful representation of the firm’s clients. He is especially skilled and experienced at pre-litigation and trial preparation. Raul especially enjoys working with clients and developing effective solutions to their concerns.

Raul speaks, reads, and writes Spanish fluently.  In his spare time, he enjoys spending time with his family, traveling, and managing a local soccer club.
